MEETING MINUTES

HARBOR & WATERFRONT COMMITTEE, HARPSWELL, MAINE

November 21, 2006

Attending

Jim Hays, Harbormaster

Amy Haible, Selectman - Absent

Committee Members:

Present: Burr Taylor, Peter Darling, Len Duda, Bill Bartley

Absent: Bill Blood, Steve Rowe, Toby Tobin

Activities

Meeting called to order at 6:00 PM.

Len Duda has a conflict with the Tuesday night meeting. We agreed to hold them on Wednesday.

Agenda per Burr Taylor: See agenda at the end of this report.

Minutes for 11/7/06 approved unanimously.

Harbormaster’s report: Jim is getting responses to the registered letter sent to about 70 Mackerel Cove mooring owners requesting that they identify their moorings with their registration number.

Old Business

1. Progress report on workshop committee to revise the ordinance. It will be completed and voted on at the next meeting on December 6th.

New Business

1. Update the priority list: a. Resident Fisherman. b. Resident Commercial Marine Enterprise. c. Resident and/or Taxpayer Recreational. d. Non-resident Fisherman. e. Non-resident Commercial Enterprise. f. Non-resident Recreational.

2. Appeals: Need to review wording of Section 9 of the Proposed Draft for the March 9, 2002 Town Meeting.

3. Floats: Pass

4. Registered in more than one name / relationship: "A mooring shall be permitted only to the registered owner(s) of the vessel listed on the permit." We will add to the ordinance next week.

5. Transfer of mooring with property sale: We will add to the Section 5.11.4 of the March 9, 2002 Draft.

6. Point of access: Passed until next meeting. The issues are; parking, town landings, proof that a point of access exists, and distance in miles.

7. Boat registration required for mooring. Yes/no? Good idea. We had a discussion on what constitutes a boat registration. State of Maine registration, a Coast Guard Document, or Bill of Sale receipt.

8. Mooring use: We will add to the ordinance. Boat, rental, pleasure, commercial, etc.

9. Can be handled on a case by case basis. Does not need to be added to the ordinance.

10, 11, 12. We ran out of time. We will complete at the next meeting.

Wednesday, December 6, December 20, 2006 at 6:00 PM, Harpswell Municipal Building.

Continuing discussion of the Ordinance Rewrite, and Harbor Management Plans.

Continuing discussion of Water Classification Plan Map: Review Special Anchorages, Anchorages, and Harbors.

9. Mooring approved but not paid for first year and new application submitted the following year. Does this allow the first year free without penalty fee?
10. Guest / additional moorings for a riparian owner
11. Proof of liability insurance.
12. Comply with State and Federal statutes, rules, and regulations

It is our goal to not go back to resolved issues until remaining issues are completed. If you would like to make a comment or ask a question, please let the chair know and we will catch it on the second run through.
Note that many in above list have been resolved or at least discussed.
