Single town withdrawal from an SAD with three or more towns
Summary of Procedure in 20-A MRSA 1405, 1403.
1.
Municipal
officers receive a petition signed by 10% or more of the number of those voting
in the last gubernatorial election,
petition being to withdraw.
2.
Municipal
officers call a special election, hold a public
hearing 10 days in advance and hold a special
election.
3.
A simple majority votes in favor
of withdrawal.
4.
The
Commissioner and Board are notified of the result
including the selectmen's
statement on the reason for the vote
result.
5.
Commissioner directs the municipal officers of the petitioning
town to appoint a committee. The committee is
appointed. One SAD 75 director is also appointed to the committee.
6.
The
committee negotiates an agreement with the SAD. The
agreement must address the specific points in
1403 (4).
7.
The
agreement is submitted to the Commissioner for conditional
approval or recommended changes.
8.
If
agreement conditionally approved, Commissioner sets the
date for a hearing,
municipal officers conduct the hearing,
forward final agreement to the Commissioner.
9.
If changes
recommended, changes are made and returned for
conditional approval.
10.
Commissioner sets vote in the town (Harpswell) and if 2/3
of those voting vote for withdrawal, the process plays out as
prescribed to complete the
withdrawal.
